Plaintiff Carine Armindo appeals the district courts grant of summary judgment to defendant Padlocker, Inc., on Armindos claim of pregnancy discrimination. The district court held that Armindo failed to establish that Padlockers asserted reason for her termination-her poor attendance record-was a pretext for unlawful pregnancy discrimination. We affirm, holding, among other things, that the Pregnancy Discrimination Act ("PDA"), 42 U.S.C. ร§ 2000e(k), is not violated by an employer who fires an employee for excessive absences, even if those absences were the result of the pregnancy, unless the employer overlooks the comparable absences of non-pregnant employees.
